Terms & Conditions

These Terms and Conditions govern the relationship between Genius Business College (“the College”) and all learners, employers, sponsors, or third parties enrolling in, funding, or participating in any programme offered by the College.

By enrolling, accessing learning materials, submitting assessments, or making any payment, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.

1. Nature of Delivery (Online & Distance Learning)

  • All programmes are offered through online and/or distance learning modalities.
  • Learners acknowledge that self-discipline, time management, and independent study are essential for successful completion.
  • The College does not guarantee uninterrupted access to online platforms and shall not be liable for temporary outages, maintenance, or technical disruptions.

2. Accreditation & Regulatory Framework

  • The College is accredited by the Quality Council for Trades and Occupations (QCTO) and/or the relevant Sector Education and Training Authority (SETA), depending on the qualification.
  • Programmes are delivered in accordance with national quality assurance and regulatory requirements.
  • The College operates under external oversight and must comply with the policies, systems, and timelines of regulatory bodies.

3. External Integrated Summative Assessment (EISA)

  • EISA assessments are administered, scheduled, and controlled exclusively by the QCTO and/or the appointed Assessment Quality Partner (AQP), and where applicable, the relevant SETA.
  • EISA dates, venues, formats, methods, and approvals are outside the control of the College.
  • The College shall not be held responsible for delays, postponements, rescheduling, cancellations, or outcomes relating to EISA assessments.
  • Completion of internal assessments does not guarantee immediate EISA access or certification timelines.
  • EISA-related delays do not constitute grounds for refunds or compensation.

4. Certification & Statements of Results

  • Certificates and Statements of Results are issued solely by SETA, QCTO, SAQA, or appointed external bodies.
  • Indicative timelines range from three (3) to six (6) months but may be extended.
  • The College cannot guarantee certification timelines.

5. Enrollment Validity & Lapsed Enrollments

  • Enrollment is valid only for the prescribed programme duration.
  • Learners inactive for a continuous period exceeding twelve (12) months shall be deemed inactive.
  • Lapsed enrollments may not be resumed under original fees, curriculum, or accreditation rules.
  • Returning learners may be required to re-enrol, complete bridging, or restart the programme.
  • The College reserves the right to refuse re-entry where continuation is no longer permitted.

6. Assessments, Deadlines & Extensions

  • Learners are responsible for meeting all assessment deadlines.
  • Extensions are granted at the College’s discretion and must be formally approved.
  • Non-submission does not entitle learners to refunds or fee reductions.

7. Academic Integrity & Misconduct

  • Plagiarism, impersonation, falsification, or academic dishonesty is strictly prohibited.
  • The College reserves the right to withhold results, disqualify assessments, or terminate enrollment.
  • Misconduct findings may be reported to relevant authorities.

8. Learner Identity & Authenticity

  • Learners confirm that all submitted work is their own.
  • The College may require identity verification at any stage.
  • Impersonation constitutes serious misconduct.

9. Technology & Connectivity Requirements

  • Learners are responsible for internet access, devices, software, and data.
  • Technical limitations do not excuse missed deadlines.

10. Communication & Notices

  • Official communication is conducted via email, LMS, and registered contact details.
  • Learners are responsible for monitoring communications.
  • Failure to read messages does not exempt compliance.

11. Learner Support & Response Times

  • Support is provided during official business hours.
  • Response times may vary based on volume and nature of queries.

12. Employer-Sponsored Learners

  • Sponsors may not cancel enrollment after registration.
  • Employment matters remain the responsibility of the employer.

13. Intellectual Property

  • All materials remain the intellectual property of the College.
  • Unauthorised sharing or commercial use is prohibited.

14. POPIA & Data Protection

  • Learner data is processed in accordance with POPIA.
  • Data may be shared with regulatory bodies as required.

15. No Guarantee of Employment

  • The College does not guarantee employment, promotion, or income outcomes.

16. Refund Policy

No refunds are issued except as explicitly provided for in the College’s Refund Policy.

17. Force Majeure

The College shall not be liable for delays or failures caused by events beyond its control, including national disruptions, regulatory actions, or system failures.

18. Limitation of Liability

The College shall not be liable for any indirect, consequential, or regulatory-related losses.

19. Amendments

The College reserves the right to amend these Terms at any time. Continued participation constitutes acceptance of updated terms.
